個人使用者利用YouTube平台上傳侵權影片,著作權人發現後,可通知YouTube將該影片下架,並可要求YouTube提供該上傳者的個人連絡資訊,以方便著作權人對其提告。但是,這些個人連絡資訊包含的範圍有多大?2020年7月9日,歐洲法院第五法庭針對Constantin Film Verleih告YouTube和Google案件做出判決[1],認為在歐盟指令中所要求提供的資訊,不包含email 位置、手機號碼、IP位置等。
本案發生於德國,原告是 Constantin Film Verleih電影公司,擁有許多影片的著作權,在本案中涉及的影音著作主要是 「Parker」和「Scary Movie 5」這二部電影。2013年和2014年,這些影片被上傳到YouTube平台。這些影片被觀看了達上萬次。原告Constantin電影公司除要求YouTube下架影片外,並要求YouTube和其母公司Google,提供上傳這些影片的用戶的相關資訊。以下稱這些上傳的用戶為系爭使用者[3]。
